FMLA in the Real World
Even after 25 years, the Family Medical Leave Act of 1993 (“FMLA”) is a law that defies easy understanding or application. While simple in concept – give sick employees time to recover without fear of losing their job – neither the black letter of the law nor multiple versions of defining regulations provide much guidance for HR practitioners who struggle to advise their operational partners on when exactly someone is entitled to take time off. This presentation will help HR partners grapple with the inherent ambiguity of the FMLA by addressing real-life examples that defy easy application of the regulations. It discusses some of the more common rules and provides advice on the best practices for handling the difficult – but all too common – situations involving employee leave in the modern workplace.
KEY TAKEAWAYS OF PRESENTATION
- Review of most common situations involving potential use of the FMLA
- Understanding how to apply the Act to real world situations that are not contemplated in the regulations
- Give ideas to attendees to help them evaluate and resolve issues in their businesses without running afoul of the complex workplace leave legal environment
